Consent for minors

For most clinical work with minors, the legal consent-giver is the custodial parent or guardian, and the minor provides age-appropriate assent. Both should be documented separately in the chart before the first recorded session. In divorced or separated families, confirm which parent has the legal authority to consent to healthcare — do not assume the parent bringing the child is the sole authority.

Adolescent confidentiality

Older minors — typically 12+ in most states, but check yours — often have specific confidentiality protections around mental health, substance use, and reproductive health disclosures. An AI scribe that produces a note automatically shared with a parent portal can violate these protections. Confirm that the scribe supports either (a) suppressing certain disclosures from the note, or (b) generating a two-tier note where sensitive content is not surfaced in the parent-facing version.

Developmentally-appropriate language

A scribe trained on adult sessions may under-serve the vocabulary and framing of pediatric work. Test whether the generated note describes developmentally-appropriate presentations without pathologizing normal-range behavior. Behavioral-health-native scribes handle this better than general medical scribes; none are perfect.

Modality-specific notes

• Play therapy — largely non-verbal; the clinician's session summary is the note. AI scribes can transcribe what verbal content exists but cannot replace clinician observation. Expect a hybrid workflow.

School-based practice

If you provide services inside a school, notes may become part of the student's educational record under FERPA in addition to their health record under HIPAA. This has two implications: (1) the school district may have institutional consent policies that override typical clinical consent, and (2) the retention and disclosure rules differ. Confirm both frameworks with the district before using an AI scribe in a school setting.
